Development
of a draft law of Republic of Armenia "On public access to
environmental information"
1. Goal of
project - to guarantee a legislative right of the public to access
environmental information with the aim of justified, timely and
effective participation in the decision making process on environmental
problems in the interests of sustainable development.
Tasks of project - to provide for implementation of principles
of the Aarhus Convention in Armenia, specifically:
· to study current legislation in Armenia in the field of public
access to environmental information with the aim to establish
its relevance to the principles of the Aarhus Convention;
· to develop a draft law containing clear definitions of terms
and provisions for collection, procession, access and distribution
of information;
· to organize assessment of the draft law by national experts
and, should financial support be available, by international experts;
· to implement public hearings on the draft law;
· to present the draft law for approval according to the procedure
existing in Armenia.
2. The draft law "Public access to environmental information"
will consist of a preamble, chapter on terminology, general provisions,
procedures of access to environmental information and a concluding
part. The preamble will explain the objectives and aims of the
draft law. In a special chapter it is planned to develop unified
terms harmonized with the Aarhus and other environmental Conventions,
as well as national legislation to exclude contradiction of definitions.
The general provisions should specify in a concise form functions
of authorities managing protection and use of the environment,
environmental monitoring, collection, processing and dissemination
of information. In the chapter about procedures of access to environmental
information there will be a description of an information request,
reply to a request, conditions, deadlines and form of information
presentation, conditions for refusal of an information request,
etc. In the concluding articles further measures, providing for
the effectiveness of the draft law will be specified.
It is expected that passing of the draft law "Access to the
environmental information" should stimulate national implementation
of the Aarhus Convention in Armenia, as well as facilitate environmental
human rights and further progress to achieve sustainable development
as a result of legislative public access to environmental information
and increased public participation in decision-making on environmental
problems.

Initial stage - in accordance with financial support.
Stages:
a) Study of current situation - 1 month.
b) Information compaign about plans to develop the draft law -
0,5 month.
c) Draft law development - 6 months.
d) Draft law assessment - 2 months.
e) Public hearings - 1, 5 month.
f) Draft law corrections - 2 months.
g) Implementation of necessary legislative procedures to present
draft law for approval - 2 months.
8. Provisional budget:
Stages:
a) 3 persons õ 1 month = 3 m/months
b) 2 persons õ 0, 5 month = 1 m/month
c) 10 persons õ 6 months = 60 m/months
d) 1 person õ 2 months = 2 m/months*
5 experts õ 600 $ = 3000 $
e) 2 persons õ 1,5 months = 3 m/months
Rent of hall, documents, etc. = 500 $

Salary of 86 persons per month on the basis of 400 $ per month
